A court-appointed federal monitor is scheduled to grill California Corrections Director Edward Alameida this week about allegations that he stopped a prison-officer perjury investigation under pressure from the prison officers' union. Questions also exist about a letter that Alameida and other top correctional officials sent the monitor saying the perjury charges couldn't be proven. Investigators have already testified before the monitor that they told Alameida and other top department officials they believed they could prove the charges. The monitor, San Francisco attorney John Hagar, wrote in legal papers that he suspects top Corrections Department officials may have undertaken "a deliberate attempt to mislead the court." U.S. District Court Judge Thelton Henderson appointed Hagar to monitor and investigate the department after years of inmate abuse at Pelican Bay State Prison. Hagar's formal title is "special master." After Pelican Bay officers Edward M. Powers and Jose R. Garcia were convicted last year of abusing inmates and sentenced to seven years in prison, Hagar ordered the department to investigate whether other officers lied on the stand to protect them. Hagar will send a report to Henderson next month. In testimony earlier this year before Hagar, department lawyer Joe Barbara and investigator Bob Ballard said they were ready to present a criminal case in March to San Francisco District Attorney Terence Hallinan, alleging that Correctional Officer William E. Jones lied on the stand during the officers' federal trial in San Francisco last year. Barbara and Ballard testified to Hagar that at a late-afternoon meeting March 27, Alameida and other top corrections officials ordered the investigation closed. Both testified that Alameida said he wanted the cases to "go away," even though the investigations were ongoing. They testified that they believed Alameida killed the investigation under pressure from the powerful officers' union, the California Correctional Peace Officers Association. The former head of the department's internal investigators, Brian Parry, also testified that immediately after the March meeting, Alameida told him to call a union official and tell him the investigation was dead. Ballard, the Corrections Department investigator, testified that he told Alameida and others in the meeting that the allegations against Jones were true. Lance Corcoran, the union's executive vice president, said he has spoken with Alameida often about investigations of officers, but he said he and the union didn't interfere in the perjury investigation. Ballard testified to Hagar that he was troubled because the day after he told a union lawyer that he intended to file criminal charges against Jones, he received a notice to report to Alameida's office. Through a spokesman, Alameida refused comment. Corrections spokesman Russ Heimerich said the director's testimony Friday will prove "anticlimactic" and will clarify what happened. |
